Refund policy

Each BiteTheBytes product has its own refund policy. Choose a product to see how withdrawal and refunds work for it.

1. Scope and statutory rights

1.1 This policy concerns Byte Editor licenses and related purchases. The seller responsible for the purchase is identified in your checkout and order confirmation. Where FastSpring or an authorized reseller is the seller, its applicable sale terms and refund process also apply. BiteTheBytes GmbH is the developer and licensor of Byte Editor.

1.2 BiteTheBytes does not offer an additional voluntary money-back guarantee under this policy. This does not restrict statutory withdrawal rights, rights concerning defective or undelivered digital products, rights arising from an unlawful charge, or any other mandatory remedy. A separate express promise applicable to your purchase remains binding.

1.3 The normal fourteen-day withdrawal period does not limit the periods for asserting other statutory claims. Withdrawal and other legal remedies have separate conditions and deadlines. Mandatory rights also remain protected for purchases through resellers and outside the EU, EEA or United Kingdom.

2. Withdrawal from a digital-content purchase

2.1 Consumers buying digital content at a distance may have a statutory withdrawal right. Under applicable German law, the normal period is fourteen days from conclusion of the contract, but it does not begin before the required withdrawal information has been supplied. Different mandatory rules, including longer periods where required information is missing, remain applicable.

2.2 For paid digital content not supplied on a physical medium, early expiry of the withdrawal right under applicable German law requires all of the following: performance has begun; you expressly agreed to performance starting before the withdrawal period ends; you acknowledged that this causes the withdrawal right to expire when performance begins; and the seller supplied the legally required contract confirmation recording the relevant consent and acknowledgement on a durable medium, such as email.

2.3 Downloading, installing, opening or activating Byte Editor alone is not a substitute for those conditions. Accepting the EULA or reading this Refund Policy does not by itself constitute that separate consent and acknowledgement. For services or other types of contract, the requirements applicable to that contract govern instead.

2.4 If a withdrawal right still exists, you may exercise it by an unequivocal statement to the seller. No reason is required. Use the seller's withdrawal instructions and any legally required online withdrawal function, or another legally valid communication method. You do not need to complete troubleshooting or obtain advance permission before withdrawing.

3. Defects, non-delivery and other remedies

3.1 Contact the responsible seller or BiteTheBytes support if Byte Editor has not been supplied or does not meet the agreed or legally required characteristics. Depending on the applicable law and circumstances, remedies may include supply, correction, replacement, price reduction, termination and reimbursement, or damages.

3.2 Downloading or activating Byte Editor, expiry of the normal withdrawal period, cancellation of a subscription, or an alleged EULA violation does not automatically remove those rights. Any right to correct a defect before a refund, and any exceptions allowing an immediate remedy, are determined by applicable law.

3.3 A seller's contractual refund obligations remain with that seller. Purchases through authorized resellers are not excluded from statutory protection. If a purchase was made through an unauthorized source, this policy does not validate that license; any mandatory claims against the responsible seller remain unaffected.

4. Subscriptions and maintenance

4.1 Ordinary subscription cancellation prevents future renewals as provided in the applicable Order Terms and mandatory law. It does not, by itself, create a voluntary pro-rata refund of a correctly charged paid period. Any statutory right to a refund or other remedy remains unaffected.

4.2 Stopping use, uninstalling the Software, or allowing maintenance to expire does not itself cancel recurring billing. Use the cancellation methods made available for your purchase, including any legally required online cancellation function. Contact support if you need help finding the appropriate method.

5. Requesting assistance or a refund

5.1 Write to support@bitethebytes.com for assistance with a Byte Editor purchase. Provide enough information to identify it, such as the order number, purchase email address and purchase date. These details help processing; missing optional information does not invalidate an otherwise effective statutory withdrawal.

5.2 If FastSpring or another reseller is the seller named in your order confirmation, you may contact that seller directly using the details and withdrawal instructions supplied with your purchase. A request sent only to BiteTheBytes does not necessarily constitute notice to a different seller; to protect a statutory deadline, also notify the seller through a valid channel. BiteTheBytes can help identify the responsible seller.

5.3 You may explain a technical issue if requesting assistance, but a statutory withdrawal requires no explanation. Do not send passwords, full payment-card details or confidential documents to make a request. Sample files are voluntary and are handled under the applicable support and privacy arrangements.

6. How refunds are paid

6.1 An owed refund is processed by the responsible seller in accordance with applicable law. For a statutory withdrawal under applicable German law, reimbursement must be made without undue delay and no later than fourteen days after the seller receives the withdrawal notice. Other remedies follow their applicable deadlines.

6.2 Reimbursement uses the original payment method unless another method is expressly agreed and causes you no additional cost, or a different method is required by law. No refund-processing fee is deducted from a statutory withdrawal reimbursement. Bank or payment-provider posting times do not remove the seller's legal obligations.

6.3 When a purchase is lawfully unwound or a license validly ends, use rights under that license cease as required by the applicable agreement and law. Your documents, source code and other User Content remain yours or the relevant rights holders' property and do not have to be deleted. Rights under a separate valid license remain unaffected.

This policy is to be read with the Byte Editor EULA, the Order Terms and the seller's transaction-specific withdrawal information. It does not replace the withdrawal notice, required form or checkout process that the responsible seller must provide. Mandatory consumer protection takes precedence over any conflicting wording.
