1. Scope and seller
This policy applies to Material Creator purchases and explains statutory withdrawal and refund rights. BiteTheBytes GmbH is located at Mainzer Str. 9, 36039 Fulda, Germany. Contact: support@bitethebytes.com.
Official storefront purchases are processed by FastSpring as merchant of record. The seller named in your order confirmation is your contracting party for the purchase; its mandatory checkout disclosures and applicable sales terms also apply. BiteTheBytes support can help identify the correct purchase and seller. This policy does not replace statutory pre-contract information or the withdrawal instructions supplied by that seller.
2. Statutory rights only
No voluntary money-back guarantee, satisfaction guarantee or additional discretionary refund program is offered. Refunds are provided only where required by applicable law.
A change of mind, non-use, dissatisfaction without a legally relevant defect, cancellation of an ongoing subscription or a breach of the EULA does not create an additional contractual refund entitlement. This does not remove any statutory right that applies to the particular purchase.
Your status as a consumer depends on the purpose of the purchase and applicable law, not simply on the name of the license tier. Outside jurisdictions granting mandatory withdrawal or refund rights, no additional right is created by this policy. Mandatory local protections, including those in the EU, EEA and UK where applicable, remain unaffected.
3. Consumer withdrawal and digital content
For an eligible consumer distance purchase under German law, the statutory withdrawal period is generally fourteen days from conclusion of the contract, provided the required withdrawal information has been given. Where information is missing or other statutory conditions apply, the legally applicable commencement, extension or expiry rules control. There is no blanket fourteen-day expiry of every possible refund claim.
For paid digital content not supplied on a physical medium, the withdrawal right can expire before that period ends only if the statutory conditions are satisfied. Under section 356(6) of the German Civil Code, these include:
- the trader has begun performance;
- before performance begins, you have expressly consented to its beginning before the withdrawal period ends;
- you have acknowledged that this causes the withdrawal right to expire when performance begins; and
- the trader has supplied the required contractual confirmation under section 312f of the German Civil Code.
A download, installation, access or activation alone does not replace these requirements. Accepting an EULA or reading this policy is not itself a separate waiver of the withdrawal right. Where different mandatory rules apply to a service or in your jurisdiction, those rules control.
To exercise an available withdrawal right, send an unequivocal statement of your decision to withdraw to the seller identified in your order confirmation, using its supplied contact details or legally available withdrawal function. You may use the seller's model withdrawal form, but a form is not compulsory. No reason is required. Dispatch within the applicable deadline is sufficient where the law so provides. You may also contact support@bitethebytes.com for assistance; assistance does not replace a time-sensitive notice to the appropriate seller.
4. Defects, non-delivery and other mandatory remedies
Statutory claims for failure to supply, defects, lack of conformity, necessary updates, price reduction, contract termination, damages or other mandatory remedies are separate from a change-of-mind withdrawal right. They do not disappear merely because you downloaded or activated the Software, or because fourteen days have elapsed.
Depending on the applicable law and facts, a correction or other cure may be required before a price reduction, termination or refund. This policy neither promises a refund where the statutory conditions are absent nor restricts one where they are met. Non-waivable remedies against the seller, licensor or another responsible party remain available.
5. Subscriptions, renewals and third-party sellers
Cancelling renewal stops future renewals according to the applicable purchase terms. It does not itself create a refund for the current paid period or past renewals. Statutory withdrawal, termination and refund rights remain unaffected. Maintenance expiry or a decision not to use a perpetual license creates no additional refund entitlement.
For a purchase through a reseller or another third-party seller, address purchase-related refund or withdrawal claims to that seller. BiteTheBytes does not offer an additional refund program for those purchases. This is not an exclusion of mandatory rights against that seller or any other party legally responsible. Purchases outside official channels do not create an extra contractual refund entitlement from BiteTheBytes.
6. Requesting a refund
Contact the seller through the purchase receipt or customer service, or write to support@bitethebytes.com for assistance. Include your order reference, purchasing email address, product and purchase date if available. For defect or non-delivery claims, describe the issue so it can be assessed. Do not send passwords or full payment-card details.
Order details help locate a purchase; they do not impose an additional form requirement on a valid statutory withdrawal notice. No prior support authorization is needed to exercise a statutory withdrawal right, and contacting support does not suspend a statutory deadline.
7. Payment and effect of a refund
Refunds are made within the period required by applicable law. For an effective withdrawal under German law, reimbursement is due without undue delay and no later than fourteen days after the trader receives the withdrawal notice. Other statutory remedies follow their applicable deadlines.
The original payment method is used unless another method is expressly agreed and no extra charge is imposed on you. Payment-provider or bank processing may affect when funds appear, but does not extend a statutory reimbursement deadline. FastSpring or the relevant seller processes the payment where it handled the purchase.
When withdrawal or a refund legally ends the license, the affected entitlement may be deactivated and further use must stop. A partial refund or statutory price reduction does not automatically terminate the entire license. Your ownership of your own lawfully created work remains unaffected, subject to applicable rights in incorporated third-party content.
